GENERAL TERMS OF USE

I. SUBJECT
Art. 1 (1) These General Terms and Conditions are intended to regulate the relationship concerning the conditions of use of the website "www.sunnybeach.com" and the conclusion of a Service Contract between "SUNNYBEACH.COM", hereinafter referred to as the CONTRACTOR, and a client or user, hereinafter referred to as the CLIENT.
(2) For all requests for the provision of service that are made via the website "www.sunnybeach.com", these General Terms and Conditions will apply exclusively and only in the version in force at the time of the request. The CUSTOMER accepts these General Terms and Conditions before completing the request.
(3) Deviations from the General Terms and Conditions are not permitted, except with our express written consent.

III. DEFINITIONS WITHIN THE MEANING OF THE GENERAL TERMS AND CONDITIONS

Art. 4 Within the meaning of the General Terms and Conditions of Use of the website "SUNNYBEACH.COM":

User /Customer within the meaning of these General Terms and Conditions/ is any natural person who makes a request to use services that are not intended for the performance of a commercial or professional activity, and any natural person who, as a party to a Service Contract with a commercial company that provides services through the website "SUNNYBEACH.COM", acts outside the scope of his commercial or professional activity.
2. Customer /Customer within the meaning of these General Terms and Conditions/ is any legal entity that makes a request for the use of services that are intended for the performance of a commercial or professional activity, and any legal entity that, as a party to a Service Contract with a commercial company "SUNNY BEACH COM" Ltd. acts within the scope of its commercial or professional activity.
3. A contractor is any natural or legal person who, within the scope of his professional or commercial activity and on the basis of a contract, provides services within the scope of his commercial or professional activity.

4. A service is any material or intellectual activity which is performed in an independent manner, is intended for another person and does not have as its main object the transfer of possession of property.

Profile /Akanut/ is a section of the website "SUNNYBEACH.COM", formed by an email address and password, which allows the Customer to request the provision of a service and which contains information about the Customer /User or Customer/ and the history of the requested service on the website "SUNNYBEACH.COM". The User/Customer is responsible for the accuracy, completeness and timeliness of all information entered in the Profile.
6. Application is an electronic document, which is a form of communication between SUNNY BEACH COM Ltd. and the USER/CUSTOMER, through which the USER/CUSTOMER declares to SUNNY BEACH COM Ltd. his/her intention to use the services provided through the SUNNYBEACH.COM website after payment by bank transfer via credit/debit card.
7. "Service Contract" means a contract, other than a contract of sale, under which the trader provides or undertakes to provide a service to the user/customer and the user/customer pays or undertakes to pay the price for it.
8. An "ancillary contract" is a contract under which the consumer acquires goods or services in connection with a distance or off-premises contract, those goods and services being provided by the trader or by a third party on the basis of an agreement between the third party and the trader.
